ABC V. STATE OF KARNATAKA & OTHERS WRIT PETITION (HC) NO. 41 OF 2024
Facts: A writ of habeas corpus was filed by a mother seeking the production of her daughter, who had informed the court that she had married and was residing with her Muslim husband in Kerala and did not wish to return to her parental home. The court directed the production of the detenue on 09.05.2024, and upon being presented, the detenue expressed her unwillingness to return to her mother. Her statement was recorded in-camera with the presence of the Deputy Secretary of the Juvenile Justice Committee, High Court of Karnataka.
Issue: Whether an interfaith couple's cohabitation after the girl voluntarily leaves home involves coercion or undue influence from the husband and his family.
Observation: The High Court concluded that since the detenue voluntarily chose to remain with her husband, and given her status as a major and student in the II Year B. Com, no further adjudication was necessary. The Court found no indication of coercion or undue influence and thus did not interfere with the detenue's choice to stay with her husband.
