Section 341: Legal aid to accused at state expanse in certain cases

Section 341 of the Bhartiya Nagarik Suraksha Sanhita, 2023 states that a person who cannot afford legal representation has the right to legal aid at the expense of the state. This ensures that justice is not denied on account of financial capacity and aligns with constitutional principles aimed at promoting equality before the law.

It requires that if a defendant has no assigned counsel and the court finds that defendant cannot obtain same, the court shall appoint an assigned counsel who shall then represent the defendant at public expense. It ensures that no person is deprived of his right to see justice due to lack of legally qualified advocate.

It vests power in the High Court, subject to the previous sanction of the State Government, to make detailed provisions relating to the administration of legal aid. Such provisions include:

-The procedure for the nomination of advocates to be appointed under this section.

-The measures of facilities which courts shall provide to such advocates.

-The fees to be paid by the government for the legal services offered by such advocates.

This structure makes the provision of legal aid orderly and not biased in its selection process as well as adequately recompenses the advocates so assigned.

It gives the State Government the ability to extend subsections (1) and (2) provision to all manners of trials heard in other courts, and such courts shall include but not limited to Courts of Session. Therefore, the said right of access to legal aid is available from one court up to the judiciary, which also means a vast expansion of justice.

To be eligible for legal aid under Section 341, the accused must prove that he lacks financial resources. The court checks the financial status of the person to ensure that only those who are really unable to afford legal representation get the benefit of state-sponsored legal aid. In this process, the court considers income, assets, and financial obligations.

-It is a great enabler, as it enables the right of access to justice not to depend on the economics of the particular individual. That is, that all accused, regardless of income, have to be provided access to competent lawyers for a proper trial.

-By guaranteeing legal representation at the state's expense for those who cannot afford it, Section 341 upholds the principles of fair trial and due process. This ensures that the accused adequately defended themselves adequately and that justice is not compromised due to lack of legal support.
