Section 50: Power to seize offensive weapons

Under Section 50 of BNSS, 2023 the police officers are entitled to seize offensive weapons from a person at the time of arrest. The provision is important to public safety and this offense meant the potential dangerous items must not be carried by persons who might become a threat in the future.
Police officers or authorized personnel have the right to take any offensive weapons found on a person immediately after their arrest. This includes knives, firearms, and other weapons that are considered offensive under the law.
All weapons seized during the arrest must be delivered to the appropriate court or officer as required by the BNSS. This ensures that there is a formal record and custody of the seized items, which is essential for legal proceedings.
The provision applies to all arrests conducted under the BNSS, and the police can act promptly in cases where a suspect may be armed and dangerous.
