It was observed that the husband's obtaining of a decree for restitution of conjugal rights was not in compliance with the decree, but rather a means to deprive the wife of her conjugal duties. Despite the wife's request to join him, the husband refused entry to the house and drove her away, along with any relatives who tried to assist her.

The court held that these actions by the husband constituted misconduct, which could not be condoned under Section 23(1)(a) of the Hindu Marriage Act, 1955. Therefore, he was rightfully denied relief under Section 13 (1A) of the Act.
