Section 79: Where warrant may be executed

Section 79 of the BNSS, 2023 outlines the authority and procedure related to the implementation of arrest warrant procedures. It empowers law enforcement to carry out such warrants in any area of India, thus removing territorial limitations and granting police operational liberty to arrest any person anywhere in the nation.

Section 79 states: "A warrant of arrest may be executed at any place in India." This provision gives the police officers the right to arrest at any place within the territorial limits of India, irrespective of the place where the warrant was issued or the place where the arresting officers are stationed. This provision enhances the mobility and effectiveness of law enforcement agencies in pursuing individuals who may attempt to evade capture by relocating to different regions.

It empowers officers to execute arrest warrants throughout India thereby greatly enhancing the operational capabilities of police. The power to arrest individuals irrespective of

jurisdictional boundaries is of particular importance where suspects, fearing getting arrested, flee to other regions. This provision ensures the mobilization of swift action; the pursuance, therefore, of persons wanted for serious offences will be swiftly accomplished without undue delay and all the attendant risks to the public safety.
