Supreme Court Flags Issue of Religious-Instruction Schools, Leaves it to Centre

• The Supreme Court on 11 May 2026 examined the legal status of schools mainly imparting religious instruction but left the matter for the Government of India to review.

• The issue relates to whether such institutions should be treated as religious/charitable bodies or as regular educational institutions under law.

• The matter involves interpretation of Article 26(a) (religious denomination’s right to establish institutions), Article 19(1)(g) (right to carry on occupation), and Article 30(1) (minority educational rights).

• The petition was filed by advocate Ashwini Kumar Upadhyay, seeking classification of religion-focused schools as religious/charitable establishments.

• A Bench headed by Justice Dipankar Datta observed that the issue falls within the domain of the Ministry of Education.

• The Supreme Court did not pass a final ruling and directed that the policy and classification question be examined by the Union Government.

• The matter was also discussed in light of comparative jurisprudence from the UK Supreme Court judgment (19 Nov 2025) on religious education in Northern Ireland controlled schools.

• The UK ruling held that religious education and collective worship violate human rights unless delivered in an objective, critical, and pluralistic manner, and withdrawal rights alone are not sufficient protection.
